HIPAA Compliance and the Protection of Cyber Security

Breaches wreak havoc on healthcare organizations. One gap in your facility's infrastructure can leave private patient data wide open for those with malicious intent to take and use to their advantage. Electronic Health Records (EHRs) can be encrypted and made useless by hackers demanding a ransom and information can be sold to interested parties who can then use it for identity theft.

Frank Ableson, owner of navitend, a managed IT services provider will speak on HIPAA and Information Security to help you better understand how to identify and mitigate the risks your facility faces.  During this interactive discussion you will learn action items for practical controls and safeguards to put into place along with effectively managing your team in the face of digital threats.  The overall objective during this session is to help you improve the security posture of your organization.

Read through these common myths about risk assessments and then decide... should you attend this session?

1.  The security risk analysis is optional for small providers.  False. All providers who are “covered entities” under HIPAA are required to perform a risk analysis.

2.  Simply installing a certified EHR fulfills the security risk analysis MU requirement.  False. Even with a certified EHR, you must perform a full security risk analysis. Security requirements address all electronic protected health information you maintain, not just what is in your EHR.

3.  My EHR vendor took care of everything I need to do about privacy and security.  False. Your EHR vendor may be able to provide information, assistance, and training on the privacy and security aspects of the EHR product. However, EHR vendors are not responsible for making their products compliant with HIPAA Privacy and Security Rules. It is solely your responsibility to have a complete risk analysis conducted.

4.  A checklist will suffice for the risk analysis requirement.  False. Checklists can be useful tools, especially when starting a risk analysis, but they fall short of performing a systematic security risk analysis or documenting that one has been performed.

5.  My security risk analysis only needs to look at my EHR.  False. Review all electronic devices that store, capture, or modify electronic protected health information. Include your EHR hardware and software and devices that can access your EHR data (e.g., your tablet computer, your practice manager’s mobile phone). Remember that copiers also store data.

6.  I only need to do a risk analysis once.  False. To comply with HIPAA, you must continue to review, correct or modify, and update security protections.

A healthcare facility's leadership must understand and treat cyber security as a high priority, taking an active role in its oversight and development. As your organization increasingly relies on sensitive data stored on corporate networks, cyber security and risk management become more intertwined.

Panelist Bios:

Frank Ableson has run navitend since its inception in 2002. navitend provides Leadership and Technology Services to its clients across the New Jersey, Eastern PA and NYC markets. Frank holds a Bachelor of Science in Operations Research and Industrial Engineering from Cornell University. He has obtained industry certifications including the Certified Information Systems Security Professional (CISSP). In addition to day to day leadership of navitend, Frank works closely with a limited number of startup businesses, assisting them to bring their technology products and services to market.

Prior to running navitend, Frank consulted for a number of corporations including Nike, Schlumberger, Hewlett Packard, Barnes and Noble.com, Palm, Warner Lambert/Pfizer, Bausch & Lomb, Altria, BASF, Handango, Microchip, PrintMail, TAG Cyber and others.

In addition to publishing software development books for the Android operating system, Frank has contributed to IBM Developerworks and Linux Magazine.

Frank is a lifelong northern New Jersey resident, currently residing in Byram Township with his wife and seven children.

Khizar Sheikh chairs the Privacy and Cybersecurity practice group at the firm Mandelbaum Salsburg. Khizar focuses his practice on cybersecurity, privacy, and data matters; and he counsels clients ranging from emerging growth companies to publicly-traded, global organizations, as well as clients from banking and financial services, consumer retail, healthcare, and education sectors.

Khizar works closely with his clients, providing advice on issues relating to data collection, storage, protection, use, and sharing. He assists clients in complying with their legal requirements for protecting personal and sensitive data arising from contracts, state, national, or international laws relating to data privacy, cybersecurity, digital advertising and marketing, virtual currencies, and social media. He is experienced in providing risk and “gap” assessments; drafting and negotiating contracts (including vendor and cloud agreements, and merger/acquisition documents) and providing ongoing training to staff,management, and boards of directors; as well as representing clients in data breach response and litigation matters involving data theft and misuse, intellectual property, and privacy torts and class actions. To assist his clients, Khizar works closely with data security, forensic, insurance, and public relations specialists. In addition to his corporate practice, Khizar also advises security researchers and “white hat” hackers on the unique legal issues that their work implicates, including counseling on contracts and threat reporting.

Glenn Tippy is Executive Vice President of the NJ office of Assured Partners, GWW Insurance Agency. Glenn has over 40 years of insurance experience, holding a variety of executive positions prior to joining GBW/AssurePartners. He is Past President of the Professional Insurance Agents of New Jersey (PIANJ). https://pia.org/ . He was appointed to the NJ Insurance Commissioner's Producer Advisory Council.

He is also Vice Chair of the New Jersey Council of Trout Unlimited, and Past President of the Hackettstown Regional Medical Center Foundation. He has served on the Boards of the New Jersey Insurance Underwriting Association and the Insurance Council of New Jersey.

Glenn holds the CPCU (Chartered Property Casualty Underwriter) and CLU (Chartered Life Underwriter) professional designations. He is a member of the Society of Financial Service Professionals and a member of the CPCU Society. He is a graduate of Yale University. He is a former Mayor of Mountain Lakes NJ and former President of its Board of Education. He has provided expert witness reports on a variety of topics. He has provided market consulting services to insurance companies as well as insurance consumers
